NUMISMA Auctions, hereinafter referred to and identified, only as “NUMISMA Auctions”, subject to its online auction activity, to the Business Terms and Conditions set out in the points described below and any other specific ones, expressed, published or posted in a proper place before the beginning of each auction. By participating in the online auctions of "NUMISMA Auctions" users accept the Business Terms and Conditions, described below, as well as any and all description or instructions regarding the way "NUMISMA Auctions" operates, as described on our online auction platform .
"NUMISMA" does not recognize any other Negotiating Terms and Conditions, in addition to those contained in our platform, therefore applying exclusively to the commercial relations between "NUMISMA", Buyers and Suppliers via the online platform.
“NUMISMA” reserves the right to review and change its Business Terms and Conditions according to its need, consequently, all users are subject to the rules and the Business Terms and Conditions in force at the time it establishes any relationship commercial. "NUMISMA" may, at any time and without prior notice, change the dates for the auctions, as well as the dates and times for the auctions' exhibitions.
NEGOTIATING TERMS AND CONDITIONS
1 - BUYERS
ART. 1º- In order to be considered, by “NUMISMA”, buyer or potential buyer, it is necessary to register on the online platform that will allow you to register in our database by assigning a bidder number. We inform that any user account registered on our platform is not transferable and only members of legal age can register, having to provide all the requested data, such as Citizen Card Number / Identity Card, date of registration. birth, TIN, address and telephone contact;
ART. 2nd - After the submission of the form, the computer system will ask you to accept the declaration of knowledge and acceptance of the Terms and Conditions of Business, only then can you proceed to complete the registration;
ART. 3rd - "NUMISMA" considers that whoever performs the registration acts in a personal name.
ART. 4th - Each buyer can only register once indicating his full and effective address, not being accepted separate;
ART. 5 - When registering, you must choose your username and no offensive names will be accepted, any infringement of the rights of third parties or use names that may be misleading. If "NUMISMA" understands that the user name does not meet the stated requirements, it reserves the right to request the user to change it; if the user does not proceed in accordance with "NUMISMA", he may cancel the registration;
ART. 6th - The login password is chosen by the user and should be kept confidential, in general, the user is responsible for all activities that he / she performs in his / her account, however, if any abuse is detected by any of the accounts user, to the detriment of “NUMISMA” or third parties, may result in the cancellation of the same;
ART. 7th - “NUMISMA” reserves the arbitrary right to refuse registration or to ignore bids from those who are not complying with the obligations to withdraw and / or pay for goods in previous auctions or are violating any legal provisions or rights to the 3rd;
ART. 8th - Cancellation of registration can also occur in the case of data protection or manipulation, namely, unpaid bids or improper use of the online platform;
ART. 9º - "NUMISMA" is hereby authorized by buyers to photograph, advertise, publish and use in any and all forms, at all times and for all purposes, the image and description of the acquired goods, with the sole purpose of identification of the same subject for sale;
ART. 10 - After the sale of any asset, "NUMISMA" reserves the right to be able to publish and use the photographs and descriptions of the same, for commercial, cultural, academic, scientific or other purposes that are not directly related to the auction of the parts in question;
ART. 11 - The bid submitted by the user constitutes a value offer to "NUMISMA", and the contract for the purchase of a lot does not materialize, nor is it completed until the auction is concluded;
ART. 12th - During each auction, interested bidders will be registered in our database so that the bidding process is done at the computer level and automatically; the user who bids with the highest value will definitely be the buyer;
ART. 13th - All auctions take place for a determined time in accordance with what is intended by “NUMISMA”. In this way, auctions end as soon as the timer closes;
ART. 14 - In the event that the offer made by the user through the bidding does not reach the “NUMISMA” server, before the official auction deadline ends, the bidding is not considered;
ART. 15th - In the event of a failure of the “NUMISMA” computer system that does not allow bids to be submitted, the remaining time for the auction in question, or any other system disturbance to be counted, the amounts determined and the bids will be temporarily interrupted ; after the fault has been eliminated, the bidding is resumed; however, we inform you that a temporarily interrupted auction will be duly indicated by our team;
ART. 16th - Considering that it is not possible to guarantee an error-free data processing software and system or to exclude any unpredictable events resulting from the use of the Internet, “NUMISMA” does not guarantee the constant and uninterrupted availability of its website and technical systems;
ART. 17th - "NUMISMA" is not responsible for damages that may occur as a result of technical failures; a malfunction can lead to a partial or total loss of registration of bids;
ART. 18th - "NUMISMA" will not be responsible for malfunctions on the part of the users' computer during the bidding or for the incorrect presentation or excessively slow data transmission by the internet provider;
ART. 19º - If serious problems are detected at the computer level in one of the online auctions of "NUMISMA", that same auction will be canceled.
2 - BIDDING
ART. 20th - All registered users can bid in any auction of "NUMISMA";
ART. 21st - The minimum bid amount corresponds to the base value of each piece;
ART. 22º - Each bid constitutes an offer of purchase value increasing the price of the Lot; the last bidder will define the highest bid, that is, the value for which the lot was sold / auctioned;
ART. 23rd - All bids made online are considered purchase and sale contracts entered into and are considered definitive and binding;
ART. 24 - A buyer is considered by "NUMISMA" to be the one who is duly registered and provided with a bidding number, bid and auction the good at the highest value;
ART. 25th - In the case of two buyers making a maximum offer of the same level, the first one presented to "NUMISMA" will be considered valid;
ART. 26th - After the auction is concluded, "NUMISMA" will contact the winning bidder via email;
ART. 27th - “NUMISMA” and its representatives, cannot act in its own name as a buyer of goods in one of its auctions;
3 - PAYMENT AND WITHDRAWAL
ART. 28º - The buyer undertakes to pay the total amount for which he bought the lot, plus the 15% sales commission (plus VAT at the rate in force according to the special regime for the sale of goods at auction);
ART. 29 - It is the buyer's obligation within 5 (five) working days following the date of the auction of the good or lot to proceed with the respective payment, and it is also the buyer's obligation to schedule the collection of the goods during the 8 (eight) days following the auction of the same. After the aforementioned period, the
“NUMISMA” reserves the right to cancel the sale, canceling the transaction and preventing the bidder from participating again.
ART. 30º - Any good or lot can only be withdrawn after full payment of the total amount due has been made; until this occurs, the Good will always be the property of “NUMISMA”;
ART. 31º - Any good that is fully paid and that is not collected by the buyer within a maximum period of 25 (twenty-five) days after auction sale, the property of that good will immediately revert to “NUMISMA”, which it can donate, sell, or auction the good, without the buyer being able to claim any compensation or indemnity for that fact; although the property has already been paid, the Buyer is solely responsible for all costs inherent in not collecting the purchased goods.
ART. 32- The collection of goods is carried out at the premises of “NUMISMA” -

ART. 33- Payments can be made by: Check, cash (within the legal limits), postal order or bank transfer, through the following data:

Payments by check, money order or bank transfer are only considered effective after good collection or sending the receipt to:

4 - HANDLING, PACKAGING AND TRANSPORT
ART. 34 - The buyer shall, at his own expense and responsibility, undertake the handling, packaging, lifting and transportation of the purchased goods. There will be goods that can be sent via CTT, being at the cost and responsibility of the buyer.
ART. 35 - In no case will collection be made.
ART. 36- Any assistance provided in these acts by “NUMISMA” through its representatives, its workers or collaborators is done as a courtesy, therefore, they cannot be attributed any type of responsibility in the event of damage, even if caused by negligence;
ART. 37- The eventual indication or suggestion of a company or individual to perform any of the aforementioned acts also excludes any liability of “NUMISMA”, its representatives, its workers or collaborators, for any damages or losses resulting from these services;
5 - NON-COMPLIANCE WITHIN THE SURVEY
ART. 38- If the buyer does not collect the acquired property within the established period, he will be responsible for the loss or damage, including theft or theft, that may occur in the property, even if they are caused by negligence or other cause by his representatives, their workers or collaborators; the buyer is equally responsible for all costs of removal, storage and / or insurance of the property in question.
6 - DESCRIPTION OF THE AUCTION'S GOODS
ART. 39- It is the responsibility of “NUMISMA” the accuracy of the descriptions of the goods put up for auction, namely with regard to the author, the materials, the style, the time and the state of conservation of the same. However, and without prejudice to the above, "NUMISMA" may have to correct publicly and verbally online the description and characteristics of any property until the time of sale, and therefore neither "NUMISMA" nor its representatives, their workers or collaborators be held responsible for such facts. The descriptions of the lots provided by “NUMISMA” according to your best knowledge may be different from the original ones, they are merely informative and do not bind “NUMISMA”;
ART. 40- The goods put up for auction are sold in the state of conservation in which they are, it is the responsibility of potential buyers to verify the accuracy of the description of each piece, namely: its authenticity, eventual restorations, defects, faults or imperfections personally presented during the exposure in the days prior to the auction;
7 - CLAIM, CLAIM OF THIRD PARTY'S GOODS
ART. 42 - If there is any kind of claim or claim by a third party or even provisional or definitive seizure of any asset by the competent authorities, regardless of the date on which the claim, claim or seizure took place, it can never be demanded by any buyer, any type of responsibility to “NUMISMA” for any losses or damages that the buyer has, and the latter must make the claim to which the seller or third party is entitled directly
ART. 43 - There is also no liability whatsoever on the part of “NUMISMA” before any buyer of a good that may be prevented from leaving the country under the legislation for the protection of Cultural Heritage, regardless of the date on which the respective inventory, listing or classification, and the buyer who feels injured should claim his hypothetical losses directly from the seller or the third party causing them;
ART. 44 - For any situation not foreseen in this article, the eventual liability of “NUMISMA” is limited to the total and simple value of the property acquired.
8 - CONDITIONS FOR BUYERS AND SELLERS - DATABASE
ART. 45 - Buyers and sellers expressly authorize the processing of their personal data collected in the auction registration form, in contracts entered into, in invoices or other documents under the terms of Law 67/98 of 26 October. This processing falls within the scope of authorization 1/99;
ART. 46 - The personal data collected from buyers and sellers are used for the purpose of processing contractual obligations and conditions and for sending information about activities, exhibitions, auctions, as well as for sending promotional information. Buyers and sellers are entitled to access and information about the personal data registered in “NUMISMA”;
ART. 47 - To change, rectify or delete personal data, buyers and / or sellers who are registered must do so through the website, via email, or letter addressed to “NUMISMA”.
9 - COMMUNICATION
ART. 48 - Any and all communication from “NUMISMA” to its customers, namely buyers, sellers, owners or accredited representatives of any of the aforementioned customers, will be carried out by email or CTT, and if it is registered, it is considered the consignee was notified 48 hours after dispatch.
10 - FORUM
ART. 49 - For the resolution of any conflict between the parties within the scope of the service provision contract entered into between them, the jurisdiction of the District of Lisbon will be competent, with express waiver of any other.
