You can place your bids during the auction by telephone, with the assistance of one of our operators. In order to take part in the telephone bidding, you must make a reservation by 11:00 am CEST on 4 May, 2022, specifying the lots you wish to bid for and your telephone number. Customers who have booked this way will be called at the number they have indicated a few lots before those for which they have expressed interest. 

A telephone bid reservation has the value of a written absentee bid at the starting price as indicated in the catalogue.

In the event of:

One single pre-auction bid on a lot

In the absence of bids during the auction, the lot will be awarded at the starting bid even if the sole bid received is higher (the amount of the pre-auction bid indicates the maximum bid the bidder is willing to place.

Example: Starting bid € 1,000 – Single pre-sale bid € 1,500 – Award at € 1,000

Multiple pre-auction bids of the same amount on the same lot

If no bids are raised during the auction, the lot will be awarded to the earlier bidder.

Multiple pre-auction bids of different amounts on the same lot

If there are no bids during the auction, the lot will be awarded to the highest bidder. The hammer price is calculated by adding to the amount of the next lowest bid an increment set out in the table below.

Example: customer A bid € 1,200 - customer B bid € 1,800. Customer B does not win at the award price of € 1,800 but at € 1,300. In other words, the automatic increase of € 100 provided for in the table is applied to the amount of the next lowest bid when the bids are within the € 1,000-1,999 bracket.

3. Payment methods

The purchasers of the winning lots will be able to choose between the following payment options:

• bank cheque or cashier’s check in favour of ACR Auctions GmbH with surcharge of € 10 for foreign checks.

• credit card and Paypal.
• Wire bank transfers may be made to ACR Auctions GmbH with surcharge of € 10 for outside European

Please note: Invoices paid by cheque, cash or bank transfer are exempt from the 3.5% of administration fees.

 

4. Buyer’s premium

The purchaser shall pay ACR Auctions GmbH an auction fee equal to 26% of the hammer price of each lot. All lots purchased on the Live-bidding of our website (www.bertolamifineart.com) are subject to an increment of 1,5% on the hammer price.
  

5. Additional costs

 Shipping costs and additional customs duties are to be borne by the buyer. In the event that, due to unjustified complaints, the goods should be returned to ACR Auctions GmbH, the customs duties and shipping costs shall be incurred by the customer.

 

6. Conditions of Sale

 The conditions of sale that govern the relationship between ACR Auctions GmbH and the customers taking part in our auctions are displayed in each catalogue. As these conditions are automatically accepted from the moment you participate in the auction, please read them carefully. 

In the event of a discrepancy between the conditions of sale published in the printed or pdf catalogue and the version that appears in the online catalogue, the online version shall prevail. 
Payment of purchased items must be made within 7 days from receipt of the invoice. If the invoice hasn’t been paid within 30 days following adjudication, will be charged a penalty of 1%/month on the amount of the unpaid invoice.

 

7. Publication of auction results

The winning bids will be published by ACR Auctions GmbH on the website  HYPERLINK "http://www.bertolamifineart.com" www.bertolamifineart.com, for information purposes only, within 10 days of the closing date.

Dieser Hinweis wird von ACR Auctions GmbH an alle Personen gerichtet, die sich für ein Los interessieren sollten. Zusätzliche Informationen, die für die Versteigerung gelten, können im Katalog für die Versteigerung, in einer Beilage des Katalogs und/oder in einem Aushang am Versteigerungsort enthalten sein, die Sie ebenfalls lesen sollten.

Die Verkaufsbedingungen, die sowohl für die Präsenz- als auch für die Online-Auktionen der ACR Auctions GmbH gelten, sind die auf der Website bertolamifinearts.com und nicht die in den gedruckten Katalogen veröffentlichten Bedingungen.

1. UNSERE ROLLE

ACR Auctions GmbH handelt in seiner Funktion als Versteigerer von Losen ausschließlich für und im Interesse des Verkäufers. Unsere Experten stehen den Kaufinteressenten zur Verfügung, um Informationen über die zu versteigernden Lose zu geben. Der Verkäufer hat ACR Auctions GmbH bevollmächtigt, das Los als sein Vertreter in seinem Namen zu verkaufen, und ACR Auctions GmbH handelt nur als Vertreter des Verkäufers, es sei denn, wir weisen ausdrücklich auf das Gegenteil hin. Jede Aussage oder Repräsentation, die wir in Bezug auf ein Los machen, wird im Namen des Verkäufers abgegeben. ACR Auctions GmbH ist Ihnen gegenüber weder vertraglich noch deliktsrechtlich (weder direkt noch indirekt, ausdrücklich, stillschweigend oder anderweitig) verpflichtet oder erklärt sich mit einer solchen Verpflichtung oder Verantwortung einverstanden. Wenn Sie erfolgreich für ein Los bieten und es erwerben, geht ACR Auctions GmbH zu diesem Zeitpunkt einen Vertrag mit dem Käufer ein. Die Bedingungen dieses Vertrages sind in unserem Käufervertrag festgelegt, den Sie weiter unten finden.

 

2. LOSE

Vorbehaltlich der vertraglichen Beschreibung, die in Fettdruck im Eintrag zum Los im Katalog abgedruckt ist, werden die Lose an den Käufer auf einer "wie besehen"- Basis mit allen Fehlern und Mängeln verkauft. Abbildungen und Fotografien, die im Katalog (mit Ausnahme der Fotografien, die ein Bestandteil der vertraglichen Beschreibung sind) oder an anderer Stelle der Lose enthalten sind, dienen ausschließlich zu Identifikationszwecken. Sie geben nicht unbedingt den tatsächlichen Zustand des Loses wieder. Ein Foto oder eine Abbildung repräsentiert möglicherweise nicht die genaue Wiedergabe der Farbe(n) des Loses. Die Lose können vor dem Verkauf besichtigt werden, und es obliegt Ihnen, sich selbst von jedem einzelnen Aspekt eines Loses zu überzeugen, einschließlich seiner Urheberschaft, Zuordnung, seines Zustands, seiner Herkunft, seiner Geschichte, seines Hintergrunds, seiner Authentizität, seines Stils, seiner Epoche, seines Alters, seiner Eignung, seiner Qualität, seiner Verkehrstauglichkeit (falls zutreffend), seines Ursprungs, seines Wertes und seines geschätzten Verkaufspreises. Es liegt in Ihrer Verantwortung, jedes Los, an dem Sie interessiert sind, zu untersuchen. Bitte bedenken Sie, dass der tatsächliche Zustand eines Loses möglicherweise nicht so gut ist, wie es das äußere Erscheinungsbild vermuten lässt. Wir können Ihnen dabei behilflich sein, genauere Inspektionen und Tests durchzuführen oder durchführen zu lassen. Bitte fragen Sie unser Team nach Einzelheiten. Jede Person, die ein Los beschädigt, wird für den entstandenen Schaden haftbar gemacht.

3. BESCHREIBUNGEN DER LOSE UND SCHÄTZUNGEN

Vertragliche Beschreibung eines Loses 

Der Katalog enthält eine Beschreibung von unseren Experten und ein Bild zu jedem Los. 

Kostenvoranschlag 

Der Schätzpreis ist neben der Beschreibung abgedruckt. Die Schätzpreise sind ausschließlich das Ergebnis der Verhandlungen zwischen ACR Auctions GmbH und dem Verkäufer. Sie berücksichtigen keine Mehrwertsteuer oder Käufergebühren. Der Schätzpreis jedes Loses ist in Euro angegeben.

Zustandsberichte 

ACR Auctions GmbH kann allen Kunden den Zustandsbericht zu jedem Los zur Verfügung stellen. Auf Wunsch wird dieser von ACR Auctions GmbH im Namen des Verkäufers kostenlos erstellt. 

Die Verantwortung des Verkäufers Ihnen gegenüber

Der Verkäufer verpflichtet sich, alle hier aufgeführten vertraglichen Verpflichtungen im Zusammenhang mit dem Verkauf der Auktionsgegenstände einzuhalten.

Die Verantwortung von ACR Auctions GmbH Ihnen gegenüber

ACR Auctions GmbH tritt beim Verkauf als Vermittler auf und verpflichtet sich, im Interesse des Verkäufers und des Käufers Analysen, Untersuchungen oder Tests zu ermöglichen, sofern diese den Gegenstand nicht beeinträchtigen oder beschädigen.

Änderungen

Beschreibungen und Schätzungen können nach Ermessen von ACR Auctions GmbH von Zeit zu Zeit durch mündliche oder schriftliche Mitteilung vor oder während einer Auktion oder durch Veröffentlichung geändert werden. Jedes Los steht vor der Versteigerung zur Besichtigung zur Verfügung. 

Authentizität

Das Auktionshaus bietet eine uneingeschränkte und dauerhafte Garantie für die Echtheit der Münzen. Alle Identifizierungen und Beschreibungen der in diesem Katalog verkauften Gegenstände sind Meinungsäußerungen und wurden in gutem Glauben gemacht.

 

4. ABLAUF DER VERSTEIGERUNG

Unsere Auktionen sind öffentliche Versteigerungen, die von jedermann besucht werden können, und Sie sollten die Gelegenheit nutzen, dies zu tun. Wir behalten uns das Recht vor, nach eigenem Ermessen den Zutritt zu unseren Räumen oder zu einer Versteigerung ohne Angabe von Gründen zu verweigern. Es liegt in unserem alleinigen Ermessen, ob der Verkauf fortgesetzt wird, ob ein Los in den Verkauf einbezogen wird, wie der Verkauf durchgeführt wird, und wir können Lose in beliebiger Reihenfolge zum Verkauf anbieten, ungeachtet der Nummern, die den Losen im Katalog zugeordnet sind. Überprüfen Sie daher das Datum und die Uhrzeit des Versteigerungsbeginns und ob es Rücknahmen oder Nachmeldungen gibt. Denken Sie daran, dass sich Rücknahmen und Nachmeldungen auf den Zeitpunkt auswirken können, zu dem ein Los, an dem Sie interessiert sind, zum Verkauf angeboten wird. Es liegt in unserem Ermessen, ein Gebot abzulehnen, eine von uns als angemessen erachtete Steigerungsstufe festzulegen, ein Los zu teilen, zwei oder mehrere Lose zusammenzulegen, ein Los aus dem Verkauf zurückzuziehen und ein Los vor Abschluss des Verkaufs erneut zur Versteigerung zu stellen. Einige Lose können mit einem Vorbehalt versehen sein. Der Versteigerer behält sich das Recht vor, einen Gegenstand nicht unter dem vertraulichen Preis zu verkaufen, oder den Gegenstand im Namen des Auftraggebers oder von BFA zurückzukaufen. Wenn ein Vorbehalt besteht, behält sich der Versteigerer das Recht vor, im Namen des Einlieferers für jedes Los bis zur Höhe des Vorbehalts gegen Bieter im Saal oder auf dem Bieter auf dem Postweg, zu bieten. Der Auktionator behält sich außerdem das Recht vor, im Namen von BFA auf jedes Los zu bieten. Der Käufer ist der Bieter, der das höchste für den Auktionator annehmbare Gebot für ein Los abgibt (unter Berücksichtigung eines eventuellen Vorbehalts) und dem das Los vom Auktionator mit dem Hammerschlag zugeteilt wird.

Bei Streitigkeiten über das höchste annehmbare Gebot entscheidet der Versteigerer nach eigenem Ermessen. Alle abgegebenen Gebote beziehen sich auf die vom Versteigerer bekannt gegebene Losnummer. Bei der Versteigerung kann ein elektronischer Währungsrechner verwendet werden. Dieses Gerät dient als allgemeiner Anhaltspunkt für den Gegenwert eines bestimmten Angebots in bestimmten Währungen. Alle Schätzungen sind in Euro angegeben. Wir übernehmen keine Verantwortung für jegliche Fehler, die bei der Verwendung des Währungsrechners auftreten könnten. Wir können Videokameras einsetzen, um die Auktion aufzuzeichnen.

5. GEBOTSABGABE

Wir akzeptieren keine Gebote von Personen, die nicht eines unserer Gebotsformulare ausgefüllt und uns zugestellt haben, entweder das Bieter-Anmeldeformular, das Abwesenheits-Gebotsformular oder das Telefon-Gebotsformular. Sie werden um einen Identitäts- und Wohnsitznachweis sowie um Referenzen gebeten, die Sie auf Verlangen vorlegen müssen, wenn Ihre Gebote von uns akzeptiert werden sollen. Bitte bringen Sie Ihren Reisepass, Ihren Führerschein (oder einen ähnlichen fotografischen Personalausweis) und einen Ankunftsnachweis mit. Wir können von Ihnen eine Kaution verlangen, bevor wir Sie zum Bieten zulassen. Wir sind berechtigt, einer Person den Zutritt zu einer Auktion zu verweigern, auch wenn diese Person ein Gebotsformular ausgefüllt hat.

Persönliches Bieten (nur im Auktionssaal)         Sie werden gebeten, am Tag der Versteigerung (oder, wenn möglich, davor) zu unserem Bieter-Registrierungsschalter für Bieter zu kommen und ein Bieter-Registrierungsformular auszufüllen. Das Bieternummern-System wird manchmal auch als "Paddle Bidding" bezeichnet. Sie erhalten eine große Karte (ein "Paddle") mit einer aufgedruckten Nummer. Diese Nummer wird Ihnen für die Teilnahme an der Versteigerung zugewiesen. Sollten Sie ein erfolgreicher Bieter sein, müssen Sie sicherstellen, dass Ihre Nummer für den Auktionator deutlich sichtbar ist und dass es Ihre Nummer ist, die als die des Käufers identifiziert wird. Sie sollten nicht zulassen, dass jemand anderes Ihr Paddle benutzt, da alle Lose auf den Namen und die Adresse, die Sie auf Ihrem Bieter-Registrierungsformular angegeben haben, in Rechnung gestellt werden. Eine einmal ausgestellte Rechnung kann nicht mehr geändert werden. Bestehen Zweifel über den Zuschlagspreis eines bestimmten Loses oder darüber, ob Sie der erfolgreiche Bieter sind, müssen Sie den Auktionator darauf aufmerksam machen, bevor das nächste Los zum Verkauf angeboten wird. Nach Beendigung der Auktion oder wenn Sie Ihr Gebot abgegeben haben, geben Sie bitte Ihren Gebotszettel bei dem Bieter-Registrierungsschalter ab.

Bieten per Telefon (nur für den Auktionssaal)                 Wenn Sie bei der Versteigerung per Telefon mitbieten möchten, bitten wir Sie, ein Formular für Telefongebote auszufüllen, das in unseren Büros oder im Katalog erhältlich ist. Bitte senden Sie es mindestens 24 Stunden vor der Auktion an das für die Auktion zuständige Büro zurück. Es liegt in Ihrer Verantwortung, sich bei unserem Bieterbüro zu vergewissern, dass Ihr Gebot eingegangen ist. Telefonanrufe werden aufgezeichnet. Die Möglichkeit der telefonischen Gebotsabgabe ist eine Ermessensleistung und steht möglicherweise nicht für alle Lose zur Verfügung. Wir sind nicht dafür verantwortlich, in Ihrem Namen zu bieten, wenn Sie zum Zeitpunkt der Auktion nicht erreichbar sind oder die Telefonverbindung während der Auktion unterbrochen wird. Unsere Mitarbeiter stehen für Telefonate in Fremdsprachen zur Verfügung, sofern dies vorher vereinbart wurde. 

Bieten per Post oder Fax                                   Formulare für Gebote in Abwesenheit finden Sie auf der Rückseite dieses Katalogs. Sie sollten ausgefüllt an das für die Auktion zuständige Büro geschickt werden. Es ist in Ihrem Interesse, das Formular so schnell wie möglich zurückzusenden, denn wenn zwei oder mehr Bieter identische Gebote für ein Los abgeben, hat das zuerst erhaltene Gebot Vorrang. In jedem Fall sollten alle Gebote mindestens 24 Stunden vor Beginn der Versteigerung eingetroffen sein. Bitte prüfen Sie Ihr Formular für Gebote in Abwesenheit sorgfältig, bevor Sie es vollständig ausgefüllt und unterschrieben an uns zurücksenden. Es liegt in Ihrer Verantwortung, sich bei unserer Bieterzentrale zu vergewissern, dass Ihr Gebot eingegangen ist. Dieser zusätzliche Service ist kostenlos und wird vertraulich behandelt. Solche Gebote werden auf Ihr eigenes Risiko abgegeben, und wir können keine Haftung dafür übernehmen, dass wir solche Gebote nicht erhalten und/oder platzieren. Alle Gebote, die in Ihrem Namen abgegeben werden, werden zum niedrigstmöglichen Preis abgegeben, unter Berücksichtigung von Reserven und anderen Geboten für das betreffende Los. Gegebenenfalls werden Ihre Gebote auf den nächsthöheren Betrag abgerundet, der mit den Gebotsabstufungen des Auktionators übereinstimmt. Neue Bieter müssen bei der Abgabe von Geboten einen Identitäts- und Adressnachweis erbringen. Andernfalls wird Ihr Gebot nicht berücksichtigt.

Bieten über einen Agenten (nur für den Auktionssaal) Gebote werden akzeptiert, wenn sie im Namen der Person abgegeben werden, die auf dem Gebotsformular als Auftraggeber genannt ist. Wir können jedoch Gebote eines Vertreters im Namen eines Auftraggebers ablehnen und verlangen eine schriftliche Bestätigung des Auftraggebers, dass der Vertreter zum Bieten berechtigt ist. 6. VERTRAG ZWISCHEN KÄUFER UND VERKÄUFER SOWIE ZWISCHEN KÄUFER UND ACR AUCTIONS GMBH

Mit dem Zuschlag des Loses an den Käufer kommt zwischen dem Verkäufer und dem Käufer ein Kaufvertrag über das Los zu den Bedingungen des Kaufvertrages zustande, der in Anhang 1 auf der Rückseite des Katalogs aufgeführt ist. Sie sind zur Zahlung des Kaufpreises verpflichtet, der sich aus dem Zuschlagspreis zuzüglich der gegebenenfalls anfallenden Mehrwertsteuer ergibt. Gleichzeitig wird auch ein separater Vertrag zwischen uns als Auktionshaus und dem Käufer geschlossen. Bitte lesen Sie die Bedingungen des Kaufvertrags und unserer Käufervereinbarung, die im Katalog enthalten sind, falls Sie der erfolgreiche Bieter sind. Wir sind berechtigt, die Bedingungen eines oder beider Verträge vor deren Abschluss zu ändern, indem wir andere Bedingungen im Katalog und/oder durch eine Beilage im Katalog und/oder durch Mitteilungen am Versteigerungsort und/oder durch mündliche Ankündigungen vor und während der Versteigerung festlegen.

7. KÄUFERPRÄMIE UND ANDERE VOM KÄUFER ZU ZAHLENDE GEBÜHREN

Gemäß dem Käufervertrag ist vom Käufer eine Prämie (die Käuferprämie) an uns zu zahlen, in Übereinstimmung mit den Bedingungen des Käufervertrags und zu den unten aufgeführten Tarifen, die in Bezug auf den Zuschlagspreis berechnet werden und zusätzlich zu diesem zahlbar sind. Lagerkosten und andere Auslagen sind ebenfalls vom Käufer zu zahlen, wie im Käufervertrag festgelegt. Die folgende Käuferprämie ist im Abschnitt "Informationen für Käufer" aufgeführt. 

Um die Steuerverfahren zwischen den EU-Ländern zu harmonisieren, wurden mit Wirkung vom 1. Januar 2001 durch Ausweitung der Differenzbesteuerung auf die Auktionshäuser neue Regeln eingeführt. Artikel. 45 des Gesetzes 342 vom 21. November 2000 sieht die Anwendung der Regelung auf Verkäufe vor, die in Ausführung von Kommissionsverträgen abgeschlossen werden:

Privatkunden;

steuerpflichtige Kunden, die der Differenzbesteuerung unterliegen;

Kunden, die nicht in der Lage waren, den Steuerabzug gemäß Art. 19, 19 bis, und 19-bis2 des DPR. 633/72 (die gut verkauft haben in frei ex-Art. 10, 27-d)

Kunden, die von der im Herkunftsstaat für Kleinunternehmen vorgesehenen Steuerbefreiungsregelung profitieren.            

Aufgrund einer besonderen Gesetzgebung wird in den oben genannten Fällen die Mehrwertsteuer oder ein Betrag anstelle der Mehrwertsteuer, falls zutreffend, vom Auktionshaus erhoben. Für Lose, die im Rahmen der Differenzbesteuerung verkauft werden, wird kein Symbol verwendet.

8. ZAHLUNG

Die Bezahlung der ersteigerten Lose hat unmittelbar nach der Auktion zu erfolgen und kann per Überweisung, Bargeld, Scheck, Bankscheck, Kreditkarte (Visa oder Mastercard) erfolgen. Sollten aufgrund von unwägbaren Situationen außergewöhnliche Wechselkursschwankungen auftreten, kann ACR Auctions GmbH nach eigenem Ermessen Rechnungen in Euro (EUR) ausstellen. ACR Auctions GmbH ist gesetzlich verpflichtet, von ihren Kunden die Vorlage eines Ausweises (Personalausweis, Führerschein, Reisepass) und einer Adressbestätigung zu verlangen. Käufer, die per Bankscheck zahlen möchten, müssen dies mit der Verwaltung vereinbaren. Es ist nicht möglich, die Ware vor der Zahlung per Scheck oder Bankwechsel vor Einlösung des Schecks zu liefern, es sei denn, es wurde vor der Auktion ausdrücklich etwas anderes vereinbart. Die Bankverbindung finden Sie auf der Rechnung. Die Zahlung per Visa oder Mastercard kann nur durch den Karteninhaber erfolgen. ACR Auctions GmbH behält sich das Recht vor, die Herkunft der eingegangenen Zahlungen zu überprüfen. ACR Auctions GmbH behält sich das Recht vor, Zahlungen, die nicht vom Käufer stammen, abzulehnen. Unter bestimmten Umständen und mit dem Einverständnis des Verkäufers kann ACR Auctions GmbH Käufern, die sie für zuverlässig hält, die Möglichkeit bieten, die erworbenen Waren in Raten zu bezahlen. Die Art und Weise des Zahlungsaufschubs wird vor dem Verkauf bekannt gegeben. Bevor ACR Auctions GmbH die Gewährung eines Zahlungsaufschubs in Betracht zieht, können Referenzen und Unterlagen über die Zuverlässigkeit und Identität des Käufers angefordert werden. 9. ABHOLUNG 

ACR Auctions GmbH verlangt bei der Abholung eines Loses einen Identitätsnachweis. Die Lose werden an Sie oder Ihren Bevollmächtigten übergeben, sobald ACR Auctions GmbH die vollständige und freigegebene Zahlung erhalten hat.

10. LAGERUNG

Es können Lager- und Bearbeitungsgebühren anfallen. Für Informationen über die Lagerungskosten nach dem Verkauf wenden Sie sich bitte an unser Kundenbüro.

11. VERLUST ODER BESCHÄDIGUNG

Die Käufer werden darauf hingewiesen, dass ACR Auctions GmbH für den Verlust oder die Beschädigung von Losen für einen Zeitraum von maximal zehn (10) Tagen nach dem Auktionsdatum die Haftung übernimmt.

12. VERSAND

Die Versandabteilung von ACR Auctions GmbH kann Käufer über den Export und den Versand von Eigentum beraten. Sie können den Kundenservice unter der Telefonnummer, die Sie auf unserer Website finden, kontaktieren. Die gesamten Versandkosten sind vom Käufer zu tragen. Zusätzlich liegt der Rechnung des Käufers ein Formular zur Übermittlung von Versandanweisungen bei. Ihr Versender wird Ihnen einen Kostenvoranschlag für die Transportversicherung zukommen lassen. Alle Sendungen sollten bei der Anlieferung ausgepackt und überprüft werden, und etwaige Unstimmigkeiten sollten dem Transportversicherer oder dem Versender unverzüglich mitgeteilt werden. Potenzielle Käufer sollten beachten, dass mehrere Länder die Einfuhr von Gegenständen verbieten, die Bestandteile gefährdeter Arten enthalten, einschließlich, aber nicht beschränkt auf Korallen, Elfenbein und Schildkrötenpanzer. Dementsprechend sollten sich Kaufinteressenten vor der Abgabe eines Gebots mit den entsprechenden Zollbestimmungen vertraut machen, wenn sie vorhaben, dieses Los in ein anderes Land einzuführen.

13. HAFTUNG DER VERKÄUFER UND/ODER DER ACR AUCTIONS GMBH

Neben den oben genannten Verantwortlichkeiten und Verpflichtungen der Verkäufer und der ACR Auctions GmbH können weder die Verkäufer noch die ACR Auctions GmbH für Fehler in der Beschreibung der Lose oder in ihren Schätzungen für den Verkauf und für mögliche Versäumnisse, die zu Verlusten oder Schäden an Eigentum oder Vermögenswerten des Käufers führen können, verantwortlich gemacht werden.

Customers who have booked this way will be called at the number they have indicated a few lots before those for which they have expressed interest. 

A telephone bid reservation has the value of a written absentee bid at the starting price as indicated in the catalogue.

In the event of:

One single pre-auction bid on a lot

In the absence of bids during the auction, the lot will be awarded at the starting bid even if the sole bid received is higher (the amount of the pre-auction bid indicates the maximum bid the bidder is willing to place.

Example: Starting bid € 1,000 – Single pre-sale bid € 1,500 – Award at € 1,000

Multiple pre-auction bids of the same amount on the same lot

If no bids are raised during the auction, the lot will be awarded to the earlier bidder.

Multiple pre-auction bids of different amounts on the same lot

If there are no bids during the auction, the lot will be awarded to the highest bidder. The hammer price is calculated by adding to the amount of the next lowest bid an increment set out in the table below.

Example: customer A bid € 1,200 - customer B bid € 1,800. Customer B does not win at the award price of € 1,800 but at € 1,300. In other words, the automatic increase of € 100 provided for in the table is applied to the amount of the next lowest bid when the bids are within the € 1,000-1,999 bracket.

3. Payment methods

The purchasers of the winning lots will be able to choose between the following payment options:

Please note: Invoices paid by cheque, cash or bank transfer are exempt from the 3.5% of administration fees.

 

4. Buyer’s premium

The purchaser shall pay ACR Auctions GmbH an auction fee equal to 26% of the hammer price of each lot. All lots purchased on the Live-bidding of our website (www.bertolamifineart.com) are subject to an increment of 1,5% on the hammer price.
  

5. Additional costs

 Shipping costs and additional customs duties are to be borne by the buyer. In the event that, due to unjustified complaints, the goods should be returned to ACR Auctions GmbH, the customs duties and shipping costs shall be incurred by the customer.

 

6. Conditions of Sale

 The conditions of sale that govern the relationship between ACR Auctions GmbH and the customers taking part in our auctions are displayed in each catalogue. As these conditions are automatically accepted from the moment you participate in the auction, please read them carefully. 

In the event of a discrepancy between the conditions of sale published in the printed or pdf catalogue and the version that appears in the online catalogue, the online version shall prevail. 
Payment of purchased items must be made within 7 days from receipt of the invoice. If the invoice hasn’t been paid within 30 days following adjudication, will be charged a penalty of 1%/month on the amount of the unpaid invoice.

 

7. Publication of auction results

The winning bids will be published by ACR Auctions GmbH on the website  HYPERLINK "http://www.bertolamifineart.com" www.bertolamifineart.com, for information purposes only, within 10 days of the closing date.

TERMS AND CONDITIONS

This notice is addressed by ACR Auctions GmbH to any person who may be interested in a Lot. Any additional information applicable to the Sale may be set out in the Catalogue for the Sale, in an insert in the Catalogue and/or in a notice displayed at the Sale venue and you should read them as well.
The terms and conditions of sales applied to both floor and online ACR Auctions GmbH sales are the ones on the bertolamifinearts.com site and not those published in the printed catalogs.

1. OUR ROLE
In its role as Auctioneer of Lots, ACR Auctions GmbH acts solely for and in the interests of the Seller. Our experts are available to prospective buyers to provide information about lots for sale.
The Seller has authorized ACR Auctions GmbH to sell the Lot as its agent on its behalf and, save where we explicitly make it clear to the contrary, ACR Auctions GmbH acts only as agent for the Seller. Any statement or representation we make in respect of a Lot is made on the Seller’s behalf.
ACR Auctions GmbH does not owe or undertake or agree to any duty or responsibility to you in contract or tort (whether direct, collateral, express, implied or otherwise). If you successfully bid for a Lot and buy it, at that stage ACR Auctions GmbH does enter into an agreement with the Buyer. The terms of that contract are set out in our Buyer’s Agreement, which you will find beneath.

2. LOTS
Subject to the Contractual Description printed in bold letters in the Entry about the Lot in the Catalogue, Lots are sold to the Buyer on an “as is” basis, with all faults and imperfections. Illustrations and photographs contained in the Catalogue (other than photographs forming part of the Contractual Description) or elsewhere of any Lots are for identification purposes only. They may not reveal the true condition of the Lot. A photograph or illustration may not reflect an accurate reproduction of the color(s) of the Lot. Lots are available for inspection prior to the Sale and it is for you to satisfy yourself as to each and every aspect of a Lot, including its authorship, attribution, condition, provenance, history, background, authenticity, style, period, age, suitability, quality, roadworthiness (if relevant), origin, value and estimated selling price. It is your responsibility to examine any Lot in which you are interested. It should be remembered that the actual condition of a Lot may not be as good as that indicated by its outward appearance. We can assist in arranging facilities for you to carry out or have carried out more detailed inspections and tests. Please ask our staff for details. Any person who damages a Lot will be held liable for the loss caused.

3. DESCRIPTIONS OF LOTS AND ESTIMATES
Contractual Description of a Lot
The Catalogue contains a description of our experts and an image about each Lot.
Estimates
The estimate is printed beside the description. Estimates are only the result of negotiations between ACR Auctions GmbH and the Seller. They does not take into account any VAT or Buyer’s fees. The estimate of each lot is in euros.
Condition Reports
ACR Auctions GmbH can give to all customers the Condition Report on each lot. If so requested, this will be provided by ACR Auctions GmbH on behalf of the Seller free of charge.
The Seller’s responsibility to you
The seller undertakes to respect all contractual obligations listed here relating the sale of the items in the auction.
ACR Auctions GmbH’s responsibility to you
ACR Auctions GmbH acts as an intermediary for the sale and it commits itself to allow analysis, study or test for the interest of the seller and buyer unless they are invasive or damaging the item.
Alterations
Descriptions and Estimates may be amended at ACR Auctions GmbH discretion from time to time by notice given orally or in writing before or during a Sale or by publication. Each lot is available for examine before the sale.
Authenticity
The Auction House offers an unconditional and everlasting guarantee for the authenticity of coin. All identifications and descriptions of the items sold in this catalogue are statements of opinion and were made in good faith.

4. CONDUCT OF THE SALE
Our Sales are public auctions which persons may attend and you should take the opportunity to do so. We do reserve the right at our sole discretion to refuse admission to our premises or to any Sale without stating a reason. We have complete discretion as to whether the Sale proceeds, whether any Lot is included in the Sale, the manner in which the Sale is conducted and we may offer Lots for Sale in any order we choose notwithstanding the numbers given to Lots in the Catalogue. You should therefore check the date and starting time of the Sale, whether there have been any withdrawals or late entries. Remember that withdrawals and late entries may affect the time at which a Lot you are interested in is put up for Sale. We have complete discretion to refuse any bid, to nominate any bidding increment we consider appropriate, to divide any Lot, to combine two or more Lots, to withdraw any Lot from a Sale and, before the Sale has been closed, to put up any Lot for auction again.
Some lots may carry a reserve. The auctioneer reserves the right not to sell an item below the confidential price, or will repurchase the item on behalf of the consignor or of BFA. If a reserve exists the auctioneer reserves the right to bid on any lot on behalf of the consignor up to the amount of the reserve against any floor or mail bidders. The auctioneer also reserves the right to bid on any lot on behalf of BFA. The Buyer will be the Bidder who makes the highest bid acceptable to the Auctioneer for any Lot (subject to any applicable Reserve) to whom the Lot is knocked down by the Auctioneer at the fall of the Auctioneer’s hammer.
Any dispute as to the highest acceptable bid will be settled by the Auctioneer at his or her absolute discretion. All bids tendered will relate to the actual Lot number announced by the Auctioneer. An electronic currency converter may be used at the Sale. This equipment is provided as a general guide as to the equivalent amount in certain currencies of a given bid. All estimates are in euros. We do not accept any responsibility for any errors which may occur in the use of the currency converter. We may use video cameras to record the Sale.
5. BIDDING
We do not accept bids from any person who has not completed and delivered to us one of our Bidding Forms, either our Bidder Registration Form, Absentee Bidding Form or Telephone Bidding Form. You will be asked for proof of identity, residence and references, which, when asked for, you must supply if your bids are to be accepted by us. Please bring your passport, driving license (or similar photographic proof of identity) and proof of address. We may request a deposit from you before allowing you to bid. We may refuse entry to a Sale to any person even if that person has completed a Bidding Form.
Bidding in person(only for auction room)
You should come to our Bidder registration desk at the Sale venue and fill out a Bidder Registration Form on (or, if possible, before) the day of the Sale. The bidding number system is sometimes referred to as “paddle bidding”. You will be issued with a large card (a “paddle”) with a printed number on it. This will be attributed to you for the purposes of the Sale. Should you be a successful Bidder you will need to ensure that your number can be clearly seen by the Auctioneer and that it is your number which is identified as the Buyer’s. You should not let anyone else use your paddle as all Lots will be invoiced to the name and address given on your Bidder Registration Form. Once an invoice is issued it will not be changed. If there is any doubt as to the Hammer Price of, or whether you are the successful Bidder of, a particular Lot, you must draw this to the attention of the Auctioneer before the next Lot is offered for Sale. At the end of the Sale, or when you have finished bidding please return your paddle to the Bidder registration desk.
Bidding by telephone (only for auction room)
If you wish to bid at the Sale by telephone, please complete a Telephone Bidding Form, which is available from our offices or in the Catalogue. Please then return it to the office responsible
for the Sale at least 24 hours in advance of the Sale. It is your responsibility to check with our Bids Office that your bid has been received. Telephone calls will be recorded. The telephone bidding facility is a discretionary service and may not be available in relation to all Lots. We will not be responsible for bidding on your behalf if you are unavailable at the time of the Sale or if the telephone connection is interrupted during bidding. Our staff will be available for phone calls in foreign languages as long as previously agreed upon.
Bidding by post or fax
Absentee Bidding Forms can be found in the back of this Catalogue and should be completed and sent to the office responsible for the Sale. It is in your interest to return your form as soon as possible, as if two or more Bidders submit identical bids for a Lot, the first bid received takes preference. In any event, all bids should be received at least 24 hours before the start of the Sale. Please check your Absentee Bidding Form carefully before returning it to us, fully completed and signed by you. It is your responsibility to check with our Bids Office that your bid has been received. This additional service is complimentary and confidential. Such bids are made at your own risk and we cannot accept liability for our failure to receive and/or place any such bids. All bids made on your behalf will be made at the lowest level possible subject to Reserves and other bids made for the Lot. Where appropriate your bids will be rounded down to the nearest amount consistent with the Auctioneer’s bidding increments. New Bidders must also provide proof of identity and address when submitting bids. Failure to do this will result in your bid not being placed.

Bidding through an agent(only for auction room)
Bids will be accepted as placed on behalf of the person named as the principal on the Bidding Form although we may refuse to accept bids from an agent on behalf of a principal and will require written confirmation from the principal confirming the agent’s authority to bid. 6. CONTRACTS BETWEEN THE BUYER AND SELLER AND THE BUYER AND ACR AUCTIONS GMBH
On the Lot being knocked down to the Buyer, a Contract for Sale of the Lot will be entered into between the Seller and the Buyer on the terms of the Contract for Sale set out in Appendix 1 at the back of the Catalogue. You will be liable to pay the Purchase Price, which is the Hammer Price plus any applicable VAT. At the same time, a separate contract is also entered into between us as Auctioneers and the Buyer. Please read the terms of the Contract for Sale and our Buyer’s Agreement contained in the Catalogue in case you are the successful Bidder. We may change the terms of either or both of these agreements prior to them being entered into, by setting out different terms in the Catalogue and/or by placing an insert in the Catalogue and/or by notices at the Sale venue and/or by oral announcements before and during the Sale.

7. BUYER’S PREMIUM AND OTHER CHARGES PAYABLE BY THE BUYER
Under the Buyer’s Agreement, a premium (the Buyer’s Premium) is payable to us by the Buyer in accordance with the terms of the Buyer’s Agreement and at rates set out below, calculated by reference to the Hammer Price and payable in addition to it. Storage charges and Expenses are also payable by the Buyer as set out in the Buyer’s Agreement. The following Buyer’s Premium is written within the “information for buyers”.
In order to harmonize tax procedures among EU countries, with effect from 1 January 2001 new rules were introduced with the extension to the Auction Houses of the margin scheme. Article. 45 of Law 342 of 21 November 2000 provides for the application of the scheme to sales concluded in execution of contracts of commission defined:
• private clients;
• clients to tax that the operation subject to the margin scheme;
• Customers who have not been able to deduct the tax in accordance with Art. 19, 19 bis, and 19-bis2 the DPR. 633/72 (which have sold well in free ex-Art. 10, 27-d)
• customers who benefit from the exemption arrangements provided for small businesses in the State of origin.
By virtue of special legislation, in cases mentioned above any VAT tax, or a sum in lieu of VAT, if applicable, it is charged by the Auction House. No symbol will be used for lots sold under the margin scheme.

8. PAYMENT
The payment of the sold lots must be made immediately after the auction and can be made by bank transfer, cash, check, bank check bank account, credit card (Visa or Mastercard). Were exceptional exchange rate variations to occur due to imponderable situations, ACR Auctions GmbH may, at its sole discretion, issue invoices in Euros (EUR).
ACR Auctions GmbH will bill to the same person that is at the registration of the pallet unless previously agreed otherwise with the Administration.

As required by law, ACR Auctions GmbH is obliged to call for their customers to show an identity document (identity card, driving license, passport) and confirmation of address.
Buyers wishing to pay by bank check must make arrangements with the Administration. It is not possible to deliver the goods before the payment by check or bank draft until encashment of the check, unless otherwise agreed prior to the auction.
You will find the bank details in the invoice.
Payment can be made by Visa or Mastercard only by the cardholder.
ACR Auctions GmbH reserves the right to check the source of the payments received. ACR Auctions GmbH reserves the right to refuse payments received from people different from the purchaser. However, in limited circumstances and in any case with the consent of the seller, ACR Auctions GmbH has the ability to offer buyers it deems reliable the option of paying for goods purchased at cadences deferred. The mode of deferred payment will be set out before the sale. Before considering whether or not to grant deferred payments, ACR Auctions GmbH may ask for references and documentation on the reliability and identity of the buyer. It will not allow anyone to withdraw the lot prior to the payment, unless credit has been granted before the auction.

9. COLLECTION
It is ACR Auctions GmbH policy to request proof of identity on collection of a lot. Lots will be released to you or your authorized representative when full and cleared payment has been received by ACR Auctions GmbH.

10. STORAGE
Storage and handling charges may apply.

11. LOSS OR DAMAGE
Buyers are reminded that ACR Auctions GmbH accepts liability for loss or damage to lots for a maximum period of ten (10) days after the date of the auction.

12. SHIPPING
ACR Auctions GmbH Shipping Department can advise buyers on exporting and shipping property. You can contact the Customer service on the number that you see in our website.
The entire shipment costs are to be paid for by the buyer. Additionally, a form to provide shipping instructions is attached to the buyer’s invoice. Your shipper will include a quote for transit insurance. All shipments should be unpacked and checked on delivery and any discrepancies notified to the transit insurer or shipper immediately.

Prospective purchasers are advised that several countries prohibit the importation of property containing materials from endangered species, including but not limited to coral, ivory and tortoiseshell. Accordingly, prospective purchasers should familiarize themselves with relevant customs regulations prior to bidding if they intend to import this lot into another country.

13. THE SELLERS AND/OR ACR AUCTIONS GMBH’ LIABILITY
Besides the responsibilities and obligations of sellers and ACR Auctions GmbH above, neither sellers nor ACR Auctions GmbH shall be held responsible for any error in the description of the lots or in their estimates for the sale and for any omissions that may result in losses or damage to property or assets to the purchaser. 

14.DATA PROTECTION – USE OF YOUR INFORMATION

Per accedere a questa modalità di partecipazione sarà necessario prenotarsi entro le 11:00 CEST del 4 maggio 2022 specificando i lotti per i quali si intende entrare in gara e un recapito telefonico. I clienti così prenotati saranno chiamati al numero di telefono da loro indicato alcuni lotti prima di quelli per cui avranno manifestato interesse. La prenotazione per la partecipazione telefonica ha il valore di un’offerta scritta alla base d’asta indicata in catalogo. Per prenotare la partecipazione telefonica compilare l’apposito modulo di offerta da inviare alle seguenti email

d. Offerte pre-asta
Sono previste le seguenti modalità di partecipazione per le offerte pre-asta:
- online previa registrazione sul nostro sito  HYPERLINK "https://auctions.bertolamifinearts.com/it/register/1" https://auctions.bertolamifinearts.com/it/register/1

- sui portali partner (Sixbid, Biddr, Numisbids ed Emaxbid) sino alle ore 11:00 CEST del 4 maggio 2022 per i lotti 1-467 e sino alle ore 11:00 CEST del 5 maggio 2022  per i lotti 468-824.
- tramite offerta scritta formulata sull’apposito modulo. Il modulo debitamente compilato dovrà pervenire pervenire entro le ore 11:00 CEST del 4 maggio 2022. Sono ammesse le seguenti modalità di trasmissione: via email  HYPERLINK "mailto:amministrazione@bertolamifineart.com" amministrazione@bertolamifineart.com o  HYPERLINK "mailto:info@bertolamifineart.com" info@bertolamifineart.com, tramite fax al numero 0039 0632609795, via posta o consegnate presso i nostri uffici.
Non vengono accettate offerte inferiori alla base d’asta.
Nel caso di:

unica offerta pre asta su un lotto

e in assenza di offerte di rilancio durante l’asta, il lotto sarà aggiudicato alla base d’asta anche ove l’unica offerta pervenuta fosse di importo superiore (l’importo dell’offerta pre asta indica infatti l’offerta massima che l’offerente è disposto ad effettuare)

Esempio: base d’asta € 1.000 – Unica offerta pre-asta € 1.500 – Aggiudicazione a € 1.000.

e in assenza di offerte di rilancio durante l’asta, il lotto sarà aggiudicato all’autore dell’offerta con data anteriore.

offerte pre asta multiple di importi diversi su un medesimo lotto

e in assenza di offerte di rilancio durante l’asta, il lotto sarà aggiudicato all’autore dell’offerta più alta a un prezzo di aggiudicazione calcolato aggiungendo all’importo dell’offerta immediatamente inferiore un incremento prestabilito nella tabella pubblicata in calce (Tabella A). Esempio: offerta cliente A €1.200, offerta cliente B € 1800. Vince il cliente B non al prezzo di aggiudicazione di € 1.800 ma di € 1.300. Viene cioè applicato all’importo dell’offerta immediatamente inferiore l’incremento automatico di € 100 previsto dalla tabella quando le offerte sono comprese nello scaglione € 1.000-1.999.

I lotti saranno visibili dal 2 al 3 maggio 2022 dalle 10:00 alle 13:00 e dalle 14:00 alle 18:00 CEST al seguente indirizzo:

3. Modalità di pagamento

Gli acquirenti dei lotti vincenti potranno scegliere tra le seguenti modalità di pagamento:

• assegno bancario o circolare non trasferibile intestato a ACR Auctions GmbH, con aggiunta all’importo della fattura di € 10 per gli assegni esteri.

• Carta di credito e Paypal

• bonifico bancario a favore di ACR Auctions GmbH, con aggiunta all’importo della fattura di € 10 (bonifici extra-Europei) 

Nota bene: le fatture pagate tramite assegno, contanti o bonifico bancario sono esenti dal pagamento delle tasse amministrative del 3,5%
Il pagamento dei lotti aggiudicati dovrà avvenire entro e non oltre 7 giorni dal ricevimento della fattura di acquisto. A partire dal 30° giorno seguente la data dell’aggiudicazione, verrà addebitata una penale dell’1%/mese sull’importo della fattura impagata.

 

4. Diritti d’asta

L’acquirente corrisponderà a ACR Auctions GmbH una commissione d’asta pari al 26% del prezzo di aggiudicazione di ciascun lotto. I lotti aggiudicati con il sistema Live-bidding del nostro sito web www.bertolamifineart.com avranno un incremento del 1,5% sul prezzo di aggiudicazione.

 

5.  Costi ulteriori

I costi di spedizione e doganali sono a carico del compratore.

Nel caso in cui, per contestazioni ingiustificate, i beni dovessero essere restituiti a ACR Auctions GmbH, le spese doganali e di spedizione saranno da considerarsi a carico del cliente.

 

6. Condizioni di vendita

Le condizioni di vendita che regolano il rapporto tra ACR Auctions GmbH e la gentile clientela che prenderà parte alle aste sono pubblicate in ogni catalogo. Poiché esse si intendono automaticamente accettate dal momento della partecipazione all’asta, si prega di leggerle con attenzione. In caso di discordanza tra la versione delle condizioni di vendita pubblicata su catalogo cartaceo o formato pdf e quella pubblicata su catalogo online, prevale la versione online. 
 

7. Pubblicazione dei risultati d’asta

L’elenco delle aggiudicazioni sarà pubblicato da ACR Auctions GmbH sul proprio sito,  HYPERLINK "http://www.bertolamifineart.com" www.bertolamifineart.com, a soli fini informativi, entro dieci giorni dalla chiusura dell’asta.

Tutte le monete sono garantite autentiche.
